Terms of Service

Welcome to 4ditor, an AI-powered real estate virtual staging platform. These Terms of Service ("Terms") govern your access to and use of our website, services, and applications (collectively, the "Services").

By accessing or using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Services.

1. Account Registration

To use certain features of our Services, you must register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

2. Subscription and Payments

Our Services include various subscription plans as well as pay-per-property options. By selecting a paid plan, you agree to pay the fees indicated for your selected option. Due to the immediate use of expensive GPU resources required to generate virtual staging images, all fees are non-refundable.

We may change our fees at any time. If we change our fees, you will be grandfathered in at your current rate as long as you remain subscribed to the same plan. If you cancel your subscription and resubscribe later, you will be charged the new fees for the plan you shall choose. If you change your plan, you will be charged the new fees for that plan.

3. User Content and Ownership

Our Services allow you to upload, submit, store, send, and receive content, including property images ("User Content"). You retain all rights in, and are solely responsible for, the User Content you upload, submit, store, send, or receive through our Services.

4ditor does not claim ownership of your User Content. You own all of your original content and the AI-generated virtual staging images created from your uploaded property images. We do not use any user content to train our AI systems.

By uploading, submitting, storing, sending, or receiving User Content through our Services, you grant us a limited license to use, host, store, reproduce, modify, create derivative works, communicate, and display such User Content solely for the purpose of providing and improving our Services to you.

You represent and warrant that:

  • You own or have the necessary rights to use and authorize us to use your User Content as described in these Terms.
  • Your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, intellectual property rights, or any other rights of any person or entity.
  • Your User Content does not contain any material that solicits personal information from anyone under 18 or exploits people under the age of 18 in a sexual or violent manner.

4. AI-Generated Content

Our Services use artificial intelligence to generate virtual staging for property images. You acknowledge that:

  • AI-generated content may not be perfect and may require adjustments.
  • The quality of AI-generated content depends on the quality of the images you provide, as well as the follow-up prompts you shall write.
  • You are responsible for reviewing AI-generated content for accuracy and appropriateness before using it for your intended purposes.

You agree not to abuse our AI system by:

  • Attempting to generate inappropriate, offensive, or illegal content
  • Overloading the system with excessive requests
  • Attempting to extract or reverse engineer our AI models
  • Using automated scripts to interact with our AI system
  • Creating multiple accounts to circumvent usage limits
  • Sharing your account credentials with others

5. Data Security and Privacy

Images you upload are stored in a secure third-party cloud environment. By default, only you can access your images and the resulting virtual staging unless you explicitly set a property and its images as public. We implement appropriate security measures to protect your data, but no method of transmission or storage is 100% secure.

6. Acceptable Use

You agree not to use the Services to:

  • Violate any applicable law or regulation.
  • Infringe the intellectual property rights of others.
  • Upload, transmit, or distribute any computer viruses, worms, or other malicious code.
  • Interfere with, disrupt, or attempt to gain unauthorized access to any computer system or network connected to our Services.
  • Harvest, collect, or gather user data without consent.
  • Use the Services for any illegal or unauthorized purpose.
  • Create multiple accounts to evade restrictions or limitations.

7. Intellectual Property Rights

The Services and their original content, features, and functionality (excluding User Content) are owned by 4ditor and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not duplicate, copy, or reuse any portion of the HTML/CSS, JavaScript, or visual design elements or concepts without express written permission from 4ditor.

8. Termination

We may terminate or suspend your account and access to the Services immediately, without prior notice or liability, for any reason, including if you breach these Terms.

Upon termination, your right to use the Services will immediately cease. If you wish to terminate your account, you may simply discontinue using the Services or contact us to request account deletion.

9. Limitation of Liability

In no event shall 4ditor, its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

  • Your access to or use of or inability to access or use the Services;
  • Any conduct or content of any third party on the Services;
  • Any content obtained from the Services; and
  • Unauthorized access, use, or alteration of your transmissions or content.

10. Disclaimer

Your use of the Services is at your sole risk. The Services are provided on an "AS IS" and "AS AVAILABLE" basis. The Services are provided without warranties of any kind, whether express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, non-infringement, or course of performance.

4ditor does not warrant that the Services will function uninterrupted, secure, or available at any particular time or location, or that any errors or defects will be corrected.

11. Indemnification

You agree to defend, indemnify, and hold harmless 4ditor and its licensees and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of:

  • Your use and access of the Services;
  • Your violation of any term of these Terms;
  • Your violation of any third-party right, including without limitation any copyright, property, or privacy right; or
  • Any claim that your User Content caused damage to a third party.

12. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

13. Geographic Restrictions

4ditor is based in Delaware, United States. We provide this Service for use only by persons located in countries where such use is legal. If you access the Service from outside the United States, you do so on your own initiative and are responsible for compliance with local laws.

14. Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.
